Abstract

Spain, has been suffering from an unprecedented economic crisis for eight years, whose legal system has been demanding the creation of mechanisms to alleviate the economic and financial burden and the accumulation of cases in Courts and Tribunals and give effective response to all legal operators, In a fast and effective way, in order to solve the problems with the best possible result. The solution is through out-of-court settlements, refinancing agreements and mediation, both commercial and bankrupt, conceived from the point of view of business continuity. In order to alleviate the disastrous effects of the crisis and to lighten the burden of the Mercantile Courts, the legislator has been hurriedly introducing, through amendments to the Insolvency Law, by a decree, various changes that will be dealt with in this Work.
