Abstract
The arbitration agreement gives rise to genuine obligations whose breach must give rise to the contractual liability of the debtor. The action for damages presents some difficulties such as the assessment of the losses generated by the defense before the unelected court, or the implications that it may have to examine again the validity of the agreement and the compensation that corresponds to the party that suffers the breach. However, its admissibility cannot be questioned. In international arbitration, it may be more complex to establish the legal bases of the action, the competent authority to resolve it and the extent of the reparation.
