Résumé
The Foreign Fighters Phenomenon is one of the most urgent contemporary security issues facing the international community. Thus, the UN Security Council adopted Resolution 2178 (2014) encouraging States to ensure that their domestic laws and regulations establish serious criminal offenses sufficient to provide the ability to prosecute and to penalize in a manner duly reflecting the seriousness of the offense of all kind of terrorism actions. This article examines the evolution of the UE efforts to fulfil this aim within their integrations mechanism allowing its citizens to live in an area of freedom, security and justice. Very different EU initiatives are part of a more general strategy of EU counterterrorism policy that includes a new legislation regulating the use of passenger name record (PNR) data for law enforcement purposes and the updating of the EU Council Framework Decision of 2002, to be able to address the new legal challenges presented by the Foreign Fighters phenomenon.
