This article aims at analyzing the different issues dealt with in the decision of 13 May 2021, issued by the Supreme Court of Spain, in relation to the possibility that the entity against which the debtor in bankruptcy claims a credit raises a plea of set-off in its statement of defence, as well as the effects of this plea on the delimitation of the jurisdiction between the Court of First Instance and the Commercial Court hearing the insolvency procedure
