The paper seeks to link the current discussions between the meaning and scope of constitutionality control, the relationship between law and morality, and the so-called "paradox of irrelevance". The basic hypothesis is that these three topics can only be correctly focused and related from a Philosophy of Law that has as a background and sustenance realistic ethics, since the alternatives offered by both skepticism and constructivism have as a starting point unsatisfactory and biased descriptions of the legal reality.
