Abstract

The protection of the rights of people with disabilities is an area that has undergone substantial change in recent decades, both internationally and in Spanish law. These changes highlight the fact that respect for the human rights, equality and dignity of people with disabilities is at stake. Our legal system has banished or relegated to a very residual role institutions with such a long tradition in national legislation as incapacitation or representation of the incapable. This new situation will necessarily affect the application of private international law in this sector.
