Abstract

The purpose of this paper is to analyze the issues dealt with in Navarra High Court of Justice Judgement No. 4/2023, of March 6, 2023, in relation to the action of the court in the procedure for the appointment of arbitrators regulated in Article 15 LA. Specifically, we will comment on the limitation of the Judge's cognition to the appropriateness of arbitration as a formula for resolving the dispute between the parties and the verification of the need for his intervention always supplementary to the agreement between the parties.
