Résumé
The "decreto-ley" (decree act) of the Spanish autonomous community was adopted by eight Autonomous Communities in the latest process of statutory reform. For this purpose, the Statutes of the Autonomous Communities have taken the state "decreto-ley" provided in article 86 of the Spanish Constitution as their model. This book discusses the extent to which this new framework is justified, and its constitutional status. It then examines the characteristics thatthe "decreto-ley" has in common across the different Autonomous Communities that have adopted it. Finally, the author centres on the concerns that have arisen out of the practical experience of these early years: over one hundred "decree acts" have been passed by Autonomous Communities, and many problems have arisen concerning their justification and possible necessity, the distinction between different areas of the law and legislative guidelines, and the practical difficulties of jurisdictional control.
